Distributors of food, the processing industry or manufacturers of components are responsible. Because undesirable or even harmful substances can unintentionally migrate into food, for example, via the packaging. Reputational damage and liability risks are possible.

Legislators in the European Union, China and in future possibly also in the USA refer to such substances as NIAS - non-intentionally added substances. The challenge for distributors of articles and food contact materials (FCMs) is that they bear the responsibility if NIAS in their products cause damage to health. This also applies without restriction to products that have been tested and approved in accordance with all relevant regulations and lists.
